"Guard Henry's evidence (taken in hospital), as to what took place after the train stopped near the top of the incline, is to the following effect:-He states that on the train stopping he put on his hand brake, and did not notice that the vacuum brake had been applied; that in about three minutes Mr. Elliott came to the van and told him to apply his brake (which he stated he had already done), and to scotch the wheels with stones: that he accordingly got out and put one stone under each of the six van wheels, and also under the three right-hand wheels of the vehicle next the van; that as he was putting down the last he felt the carriages coming back, upon which he at once got into the van, and tried, with the assistance of two passengers, to get an extra turn at the brake handle; and was still doing this when Mr. Elliott jumped up on the left step and told him to do the best he could with the brake without breaking the handle, Henry replying that he could do no more. Henry states that Mr. Elliott then said, "Oh, my God! we'll all be killed," and jumped off; that the speed gradually increased till it became so fast that the hedges could not be seen as they were passed; that he was still in the van when the crash took place, and knew nothing more till he came to his senses in the infirmary; that it had been his intention to go back and protect the train with fog signals, &c. after he had done scotching the wheels."
